Terms & Conditions

These Terms and Conditions ("Terms") govern your use of the website golfpaupack.com and any related services, bookings, purchases, and communications offered by Paupack Hills Golf Course ("Paupack Hills," "we," "us," or "our"). By accessing the Site, booking a tee time, purchasing goods or services, or subscribing to our text messaging program, you agree to these Terms. If you do not agree, please do not use the Site.

1. Eligibility

You must be at least 18 years old, or have the consent of a parent or legal guardian, to use the Site, book a tee time, make a purchase, or opt in to our SMS program.

2. Use of the Site

You agree to use the Site only for lawful purposes and in a manner that does not infringe the rights of, or restrict or inhibit the use and enjoyment of, the Site by any third party. You may not:

• Attempt to gain unauthorized access to the Site, our servers, or any related systems
• Use automated tools (bots, scrapers) to access the Site except for legitimate search engine indexing
• Upload viruses, malicious code, or any content that is unlawful, harassing, defamatory, or otherwise objectionable
• Use the Site to impersonate any person or misrepresent your affiliation with any person or entity

3. Tee Time Bookings

Tee time reservations are made through the Site using our golf POS provider. By booking a tee time you agree to:

• Arrive at the course at least 15 minutes before your scheduled tee time
• Pay the published green fee and any applicable cart fee at check-in or at the time of booking, as indicated
• Comply with all course rules, dress code, pace of play guidelines, and instructions from staff and rangers

Cancellation policy. Cancellations made more than 48 hours before your tee time receive a full refund. Cancellations within 48 hours may be subject to a fee equal to the green fee.

No-shows. No-shows may be charged the full green fee at our discretion and may have future booking privileges restricted.

Weather and course closures. Paupack Hills reserves the right to close the course or delay play due to weather, course conditions, maintenance, tournaments, or other operational reasons. In the event of a closure that prevents play, we will offer a refund or a rain check at our discretion.

4. Purchases and Payments

All purchases — including green fees, memberships, pro shop merchandise, and event registrations — are processed through our payment provider (Stripe) or our golf POS. By submitting payment information, you represent that you are authorized to use the payment method and authorize us (or our payment provider) to charge the full amount of your transaction.

Prices are shown in U.S. dollars and are subject to applicable taxes. Prices may change at any time without notice. We reserve the right to refuse or cancel any order, including for suspected fraud, pricing errors, or product unavailability.

5. Refunds and Returns

• Green fees: Refundable under the cancellation policy in Section 3.
• Memberships: Non-refundable except as required by law or as expressly stated in your membership agreement.
• Pro shop merchandise: Unworn items in original condition may be returned within 30 days with receipt for a refund or exchange. Special-order items, gift cards, and custom-fit clubs are final sale.
• Events and tournaments: Refund eligibility is stated in the event listing at time of registration.

6. Memberships

Membership terms, dues, benefits, and renewal conditions are set forth in the separate Membership Agreement provided at the time of enrollment. In the event of a conflict between these Terms and your Membership Agreement, the Membership Agreement controls with respect to membership matters.

7. SMS / Text Messaging Program Terms

By opting in to the Paupack Hills SMS program, you agree to the following terms in addition to anything stated in our Privacy Policy:

• Opt-in. Opting in is voluntary. You may opt in by checking the SMS consent box on our website, completing a paper form at the club, or texting a designated keyword to our number. Consent to receive marketing text messages is not a condition of any purchase.
• Programs. We operate SMS programs for tee time confirmations and reminders, course condition and weather alerts, event announcements, membership updates, and promotional offers.
• Message frequency. Message frequency varies. You may receive up to several messages per week.
• Charges. Message and data rates may apply. Paupack Hills does not charge for messages, but your carrier may.
• Opt-out. Reply STOP to any message to cancel. You will receive a confirmation message and no further messages until you opt in again.
• Help. Reply HELP for assistance or contact us using the information in Section 14.
• Supported carriers. Major U.S. carriers including AT&T, Verizon, T-Mobile, US Cellular, Sprint, Boost, MetroPCS, and others. Carriers are not liable for delayed or undelivered messages.
• No third-party sharing. Mobile information and SMS opt-in data are not shared with third parties or affiliates for marketing purposes.
• Eligibility. You represent that you are the account holder of the mobile number you provide, or that you have authorization from the account holder.

8. Intellectual Property

All content on the Site — including text, logos, photographs, course layouts and imagery, graphics, video, audio, and software — is owned by Paupack Hills or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws. You may view and print pages from the Site for your personal, non-commercial use. You may not reproduce, distribute, modify, publicly display, or create derivative works from any content without our prior written permission.

"Paupack Hills" and our logos are trademarks of Paupack Hills Golf Course.

9. User-Submitted Content

If you submit content to the Site (for example, a review, comment, or photograph), you grant Paupack Hills a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, modify, and display that content in connection with operating and promoting the business. You represent that you own or have the right to submit the content and that it does not infringe any third party's rights.

We may remove user-submitted content at our discretion, including content that is unlawful, offensive, or violates these Terms.

10. Assumption of Risk

Golf and use of a golf course involve inherent risks, including the risk of injury from errant golf balls, golf clubs, golf carts, terrain, weather, and the conduct of other players. By entering and using the course, you voluntarily assume all such risks. You are responsible for your own safety and for following all course rules and posted signage.

11. Disclaimers

THE SITE AND ALL CONTENT, GOODS, AND SERVICES OFFERED THROUGH IT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PAUPACK HILLS AND ITS OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE, YOUR USE OF THE COURSE, OR ANY GOODS OR SERVICES OBTAINED THROUGH THE SITE, WHETHER BASED IN CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100.00).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you.

13. Indemnification

You agree to indemnify, defend, and hold harmless Paupack Hills and its officers, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Site, your violation of these Terms, or your violation of any third party's rights.

14. Governing Law and Disputes

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or your use of the Site shall be resolved exclusively in the state or federal courts located in Pike County, Pennsylvania, and you consent to the personal jurisdiction of those courts.

15. Changes to These Terms

We may update these Terms from time to time. The "Last Updated" date at the top reflects the most recent revision. Material changes will be announced on the Site. Your continued use of the Site after a change becomes effective constitutes acceptance of the updated Terms.

16. Miscellaneous

If any provision of these Terms is held unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision is not a waiver of that right or provision. These Terms, together with our Privacy Policy and any agreement specific to a product or service you purchase, constitute the entire agreement between you and Paupack Hills regarding the Site.
